The rape case which was filed against Biodun Fatoyinbo by the wife of Timi Dakolo, Busola Dakolo at the High Court of the Federal Capital Territory has been dismissed.
The presiding judge, Justice Oathman A. Musa, on Thursday dismissed the case against the Commonwealth of Zion Assembly Senior Pastor, stating the case is empty and purely sentimental, also stated that the case was aimed as an act of cruelty than seeking justice.
The court, demands that Busola Dakolo awards Biodun Fatoyinbo with a sum of 1million naira for damages and held that the fine should have been 10 times more because the court’s time was wasted.
In June 2019, Busola called out the COZA pastor over an allegation of rape which took so many Nigerians in protesting against the senior pastor. She told the High Court that the rape had affected her marital sex life and demanded a letter of apology from Fatoyinbo.
Nigerians are also reacting on Twitter concerning the final decision of the court, as the CEO of Sapphire perfume, Adewale Aladejana says,” Congrats Baba @biodunfatoyinbo we said it from the beginning. The case has been dismissed and damages of one million Naira is to be paid to @bidounfatoyinbo”.

According to the lawyer representing Busola Dakolo, it is stated that:

A statement released from the legal representative of Busola Dakolo
reads: “We have received several calls after the ruling of the High Court of the Federal Capital Territory sitting in Bwari this morning seeking our view on the decision of the Court, ……hence, this statement. 1. The Court ruled that the matter is statute-barred because the events that crystallized to form the cause of action took place 16 years ago and that the Claimant, …… Mrs. Busola Dakolo, has only 6 years within which to seek redress in court in line with the statute of limitation.
Update: Busola Dakolo V. Biodun Fatoyinbo. The clerk called the lawyers of Busola Dakolo late last night notifying them of the judge’s ruling on the preliminary objection today. As expected, a mockery of our processes and law was the case as the drama unfolds.
